The EB-2 NIW Platform (the “Service” or “Platform”) is operated by Oscar Pardo Consulting SLU, doing business as (dba) Oscar's Green Card, a company incorporated in Spain (NIF B56741572) (“we,” “us,” or “our”). The Platform is a guided, hybrid learning-and-drafting tool that uses artificial intelligence to help self-petitioners assemble an EB-2 National Interest Waiver (NIW) petition. It provides document-organisation tools, AI assistants, educational content, and the generation of a draft petition cover letter in Word format together with an organised exhibit package.
By creating an account, accepting these terms, or using the Platform, you agree to be bound by them. If you do not agree, do not use the Service.
The Service is a digital product. Immediately after your payment is completed, you are granted access to the digital Platform and its tools, educational content, and AI assistants. Performance of the contract therefore begins, and the digital content begins to be supplied, immediately upon payment.
Because the Service is digital and is made available to you immediately upon payment, all sales are final and no refunds are provided. By purchasing, you expressly request that we begin supplying the digital content immediately, and you acknowledge and agree that you lose any right of withdrawal or cancellation once access has been granted.
EU/EEA consumers: distance contracts normally carry a 14-day right of withdrawal. For digital content supplied immediately, this right is lost once supply has begun, provided you gave your prior express consent and acknowledged the loss of that right — which you do by purchasing and accepting these terms. You retain all mandatory statutory rights that cannot be waived, including remedies if the Service is faulty or not as described.
If a technical failure on our side prevents the Service from being delivered, contact us and we will work to resolve it or provide an appropriate remedy.
We are not a law firm and we do not provide legal advice. Nothing on the Platform or produced by it constitutes legal advice, legal representation, or the practice of immigration law. Use of the Service does not create an attorney-client relationship between you and Oscar Pardo Consulting SLU or any of its personnel.
The Platform and all downloadable materials are provided for educational and informational purposes only. They reflect the experience of a self-petitioner who is a scientist, not a lawyer, and who completed the EB-2 NIW process. You may find value in them, but you use all materials at your own risk.
The Platform provides educational resources and AI-assisted drafting tools only. The documents it generates are starting points for your own review. You are solely responsible for verifying their accuracy, completing all required sections, and deciding whether and how to file with USCIS or any other agency. We strongly recommend consulting a licensed immigration attorney before filing.
Immigration laws, programs, fees, and USCIS requirements can change at any time at the discretion of the relevant government authorities, and we have no control over such changes. We are not responsible for any change in law or policy that affects your petition or eligibility. By using the Service you discharge us from any liability or responsibility in this regard.
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the security of your account credentials and for all activity under your account.
The Platform is intended solely for individual do-it-yourself self-petitioners preparing their own petition, and their direct family members who are part of the same immigration process. It is not for use by attorneys, paralegals, consultants, agencies, or anyone preparing petitions on behalf of others. Such use is not permitted without our separate written agreement, and unauthorised use will result in termination of access without a refund.
Each purchase entitles you to prepare and generate the petition of a single beneficiary. Family members may use the Platform to work together on that one person's petition (for example, a spouse assisting with the other spouse's case), but a single purchase does not entitle more than one person to prepare or generate their own separate petitions; each additional petition requires its own purchase.
The petition draft, exhibit package, and any reports or briefing documents are generated by AI systems that are not infallible. AI outputs may contain errors, omissions, or outdated information. We do not guarantee that any output is accurate, complete, legally sufficient, or suitable for filing. You must review all outputs carefully before using them.
We make no representation or warranty that using this Service will result in the approval of your EB-2 NIW petition or any other immigration benefit. USCIS adjudication decisions depend on many factors outside our control. Results achieved by other users are not a guarantee of your outcome.
You are solely responsible for:
The Service is offered at the price displayed at checkout. You may pay either (a) as a single one-time payment, or (b) where offered, in three (3) equal monthly installments (a “payment plan”). Payment is processed securely through Stripe. Your purchase includes access to the Platform for a period of twelve (12) months from the date of your first payment, and a set number of included petition generation attempts and recommendation-letter draft generations, as described on the Platform. Prices are in U.S. dollars unless stated otherwise and exclude any taxes that may apply.
Payment plan — authorisation. If you choose the payment plan, you authorise us, through our payment processor, to automatically charge your payment method the monthly installment amount shown at checkout on each of three (3) consecutive monthly billing dates until the full price is paid. The total payable under the payment plan is the sum of the three installments displayed at checkout, which is higher than the one-time price. The payment plan is a payment schedule for the same Service; it is not a subscription for ongoing or additional services, and it ends automatically once the three installments are paid.
Payment plan — access, generation, and early payoff. If you choose the payment plan, you are granted full access to the Platform, including generation of your petition draft and exhibit package, upon your first successful payment. You are not required to wait until the plan is fully paid to generate your petition, and your obligation to complete all three (3) installments continues regardless of when you generate. You may settle your remaining balance early at any time; if you do, we honour the one-time price as your total (which is lower than the sum of the three installments), your remaining monthly charges stop, and your account is treated as paid in full.
Payment plan — missed payments and pausing of access. If any installment fails or is not collected on its due date, your access to the Platform will be automatically paused and your account deactivated until the outstanding amount is successfully paid. We will notify you by email that a payment has failed and that payment is required to continue using the Platform. While your access is paused you will not be able to use the Platform or its tools. Access is restored automatically once the outstanding payment is successfully collected, and we may retry the charge on the payment method on file.
Payment plan — no refunds and incomplete plans. All payments are non-refundable, including any installments already paid, consistent with Section 2 above. If you do not complete all three installments, your access remains paused and no refund is due for amounts already paid, and we may terminate access where the payment plan is not completed within a reasonable time. You remain responsible for the installment amounts you have authorised. Choosing the payment plan does not change the “no refunds” nature of the Service.
Additional petition generation attempts and additional letter-draft generations may be purchased separately at the prices displayed on the Platform. You may renew your access for a further period at the renewal price shown, subject to the limits stated on the Platform.
You retain ownership of all documents and content you upload. You grant us a limited, non-exclusive licence to host and process that content solely to provide the Service (including transmission to the AI providers that generate your draft). We do not use your documents or petition content to train AI models, and we do not share them with third parties except the service providers listed in our Privacy Policy who help us operate the Platform.
The generated petition draft and accompanying documents are provided for your personal use in connection with your own immigration petition. The Platform itself, including its software, educational content, video lessons, and templates, is our intellectual property or that of our licensors.
You agree not to resell, share, publish, or redistribute the Platform's materials, content, or outputs in any way, except that you may share them with immediate family members who are part of the same immigration process. You may not use Platform outputs or content on behalf of third parties.
You agree not to misuse the Platform, including by not:
Where the Platform offers community or question-and-answer features, you agree to engage respectfully and civilly with other members, instructors, and staff. You agree not to contact other members outside the Platform, and not to solicit, advertise, or offer third-party products or services to other members.
We reserve the right, at our sole discretion, to suspend or terminate access without a refund for any user whose behavior we consider inappropriate, disruptive, harmful to the learning environment, or otherwise in breach of these terms.
We may refer you to independent partners (for example, providers of independent expert opinion letters or professional/business plans) and may receive a referral fee or offer you a discount. These partners are independent businesses. We are not responsible for their services, and any engagement you enter into with them is solely between you and the partner, governed by their own terms.
Our handling of your personal data is described in our Privacy Policy, which forms part of these terms and is reproduced together with these terms in your signed acceptance record.
The Service is provided “as is” and “as available,” without warranties of any kind except those that cannot be excluded by law. To the fullest extent permitted by applicable law, Oscar Pardo Consulting SLU shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including denial of your immigration petition, reliance on AI-generated outputs, or loss of data. Our total liability for any claim shall not exceed the amount you paid for the Service.
Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including the mandatory statutory rights of consumers.
These terms are governed by the laws of Spain, without prejudice to any mandatory consumer protection rules of the country in which you reside. Disputes shall be subject to the competent courts of Spain, except where applicable consumer law entitles you to bring proceedings in your country of residence. EU consumers may also use the European Commission’s Online Dispute Resolution platform.
We may update these terms from time to time. If we make material changes, we will notify you by email or by a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
